
The Economic Freedom Fighters (EFF) has filed court papers on Tuesday, 8 April 2025, at the Western Cape High Court to get the Court to declare the adoption of the budget by National Assembly invalid and unconstitutional.
The Government of National Unity (GNU) is facing serious challenges, including that of getting its budget adopted. Though the African National Congress (ANC) managed to get its proposed budget passed through the aid of smaller parties within and outside the GNU, they are not out of the woods yet.
The Democratic Alliance (DA) also is not happy with the budget and headed to court to challenge the adoption of the Fiscal Framework and Revenue Collection; which the EFF also decided to pursue the same course on their own.
According to the EFF, the Standing Committee on Finance, after considering the report on fiscal framework, failed to adopt the report in a manner consistent with the law and rules of parliament.
“The committee did not make the recommendations required by section 8(5) of the Money Bills Amendment Procedure and Related Matters Act, and no deliberations or formal vote on the report took place before it was tabled in the National Assembly specifically on this matter. Instead, the framework of the statement was inserted post adoption of the report. What was passed in the National Assembly was, therefore, not a lawful report, but a document pushed through in violation of the Constitution and the Money Bills Act,” said the party in a statement.
The EFF says it is putting its foot down as the ruling party has been at liberty for far too long in wrong doing taking advantage of their numbers in parliament, and that parliament cannot operate as a rubber stamp over the executive. The EFF says it has taken this stance in order to protect the integrity of parliament.
“The EFF will not sit back while the constitutional order is being violated. We remain committed to using every legal and political mechanism available to defend the integrity of our democratic institutions and to ensure that public money is managed lawfully, transparently, and in the best interest of the people of South Africa,” said the EFF.
