The Free State Department of Cooperative Governance and Traditional Affairs (CoGTA) has noted the decision to strike off the roll, the application brought by Cllr. Paratlane Andries Motloung, who was elected as an Executive Mayor of Maluti-A-Phofung Local Municiaplity following a council meeting that was marred by chaos and disruptive conduct by unnamed people.
The department says the case was brought before the Free State High Court in Bloemfontein on an urgent basis against sixteen respondents, amongst them the MEC for CoGTA and Human Settlements Mr. Saki Mokoena, and the Council of the municipality.
“The grounds for the application sought to interdict the continuation of the Special Council meeting from taking place on the 8th of April 2026. The applicant argued in his founding affidavit that such continuation will result in the meeting being convened unlawfully.
In his letter to the Speaker of the municipality, MEC for CoGTA and Human Settlements Mr. Saki Mokoena advised that the meeting that elected the Executive Mayor was riddled with irregularities and that going forward, council must strictly observe the law including its own Standing Rules and Orders,” explained Zimasa Mbewu, the Spokesperson for CoGTA in the Free State.
Mbewu said the advice was given in line with the MEC’s constitutional obligation of support and provide oversight of Municipalities to enhance the centrality of the rule of law.
